Worker Guidelines
These Worker Guidelines apply to every individual who uses Return My Cart to perform cart-return activity ("Workers"). They are incorporated into the Terms and Conditions and must be followed at all times.
1. Independent Contractor Status
You are an independent contractor. You are not an employee, agent, joint venturer, or partner of Return My Cart or of any Store. You choose when, where, and whether to perform cart returns. You provide your own transportation, equipment, fuel, and any personal protective gear.
2. Eligibility
- Be at least 18 years old.
- Have legal authorization to work as an independent contractor in the United States.
- Maintain a valid email and, if receiving payouts, a verified Stripe Connect account.
3. Safety First
- Obey all traffic laws and pedestrian rules. Never push carts into active traffic.
- Be aware of your surroundings, especially in parking lots and driveways.
- Do not work while impaired by alcohol, drugs, or fatigue.
- Wear weather-appropriate clothing and visible attire at night.
- Do not lift or move more carts than you can safely control.
4. Respect for Property and People
- Stay on publicly accessible areas and approved Store property. Do not trespass on private property, neighboring businesses, or residential property.
- Do not enter restricted, fenced, locked, or staff-only areas.
- Do not damage carts, vehicles, landscaping, or any other property.
- Do not engage with Store customers, employees, or bystanders in a hostile, threatening, harassing, or discriminatory manner.
- Follow the lawful directions of Store staff and posted signage.
- If asked by a Store, property owner, or law enforcement to leave, leave immediately.
5. Carts Only Belong to Their Store
- Only return a cart to the Store that owns it. Do not mix carts between stores.
- Do not take carts off-site, home, or to a personal vehicle for storage.
- Do not use carts to transport personal items, people, or animals.
- Report damaged carts in the submission notes; do not attempt repairs.
6. Submission Integrity
- Submit clear, current photos of the actual cart(s) returned at the actual Store location.
- Do not stage, reuse, or alter photos. Do not submit duplicate or fabricated runs.
- Do not submit returns for carts you did not personally retrieve and return.
- Fraudulent submissions will result in payout reversal, account termination, and may be reported to law enforcement.
7. Payments and Taxes
- Payouts are made via the payment processor (Stripe) after submissions are accepted.
- You are solely responsible for reporting and paying any applicable income, self-employment, or other taxes.
- Return My Cart does not withhold taxes from your payouts.
8. Insurance
Return My Cart does not provide workers' compensation, health, disability, automobile, or general liability insurance to Workers. You are responsible for obtaining and maintaining any insurance you choose to carry for your activities.
9. Assumption of Risk
You understand that cart-return activity involves inherent risks, including but not limited to slip-and-fall, vehicle traffic, weather, lifting/pushing strain, and interactions with the public. You voluntarily assume all such risks and agree that Return My Cart is not liable for any injury, loss, or damage you suffer or cause while performing this activity.
10. Indemnification
You agree to defend, indemnify, and hold harmless Return My Cart and all Stores from any claims, damages, fines, or expenses (including reasonable attorneys' fees) arising from your acts or omissions while using the Service, including any property damage, personal injury, trespass, traffic violation, or third-party claim caused by you.
11. Compliance with Law
You agree to comply with all applicable federal, state, and local laws, including traffic, trespass, business licensing, and tax laws. You will not use the Service to engage in any unlawful activity.
12. Enforcement
Violations of these Guidelines may result in warning, removal of submissions, reversal of payouts, temporary suspension, or permanent termination of your account, at Return My Cart's sole discretion. Serious violations (fraud, theft, violence, repeated trespass) will result in immediate termination.
13. Governing Law and Venue
These Guidelines are governed by the laws of the State of Nevada. Any dispute arising out of or relating to these Guidelines will be brought exclusively in the state or federal courts located in Clark County, Nevada (Las Vegas).
