Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of the Return My Cart website, mobile/PWA application, and related services (collectively, the "Service"), operated by Return My Cart ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Return My Cart is a technology platform that connects independent third-party individuals ("Workers") with retail or commercial property owners and operators ("Stores") who wish to have stray shopping carts returned to their premises. Return My Cart is not a party to the underlying cart-return activity, does not employ Workers, and does not own, operate, or control any Store, parking lot, cart, or other property.
2. Eligibility and Accounts
- You must be at least 18 years old and able to form a binding contract.
- You agree to provide accurate, current, and complete information and to keep it updated.
- You are responsible for all activity that occurs under your account and for keeping your credentials secure.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3. Roles
Workers must additionally agree to the Worker Guidelines. Stores must additionally agree to the Store Agreement. Those documents are incorporated into and form part of these Terms.
4. Independent Contractors; No Employment
Workers are independent contractors. Nothing in these Terms creates an employer-employee, agency, partnership, joint venture, or franchise relationship between Return My Cart and any Worker or Store, or between any Store and any Worker. Workers are solely responsible for determining when, where, and how they perform any cart-return activity.
5. Payments and Fees
- Stores fund their account balance to pay for completed cart returns and platform fees.
- Workers receive payouts for verified, accepted submissions, net of any platform fees.
- Payment processing is provided by third parties (e.g., Stripe). Their terms apply to those transactions.
- All fees are non-refundable except as required by law or expressly stated in the Service.
- You are responsible for any taxes owed on amounts you receive.
6. Acceptable Use
You agree not to:
- Submit fraudulent, duplicate, staged, or misleading cart-return submissions.
- Trespass on private property, damage property, or interfere with Store operations or customers.
- Harass, threaten, or harm any person, including Store staff, customers, or other Workers.
- Use the Service to violate any law, regulation, or third-party right.
- Reverse engineer, scrape, or interfere with the Service's security or integrity.
7. Submissions, Photos, and Content
You grant Return My Cart a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and use content you submit (such as cart-return photos, location data, and notes) for the purpose of operating, improving, and securing the Service, including fraud prevention and dispute resolution. You represent that you have all rights necessary to grant this license and that your content does not violate any law or third-party right.
8. Store / Worker Disputes
Stores and Workers are solely responsible for resolving disputes between themselves regarding cart returns, property condition, or conduct. Return My Cart may, at its sole discretion and without obligation, review submissions, reverse credits, or remove accounts where fraud, abuse, or material policy violations are suspected.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. Return My Cart DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY WORKER OR STORE WILL BEHAVE IN A PARTICULAR MANNER.
Return My Cart is not responsible for the acts, omissions, conduct, or property of Workers, Stores, customers, or any other third party. Stores acknowledge that Workers are not employees, agents, or contractors of Return My Cart for any purpose related to the physical act of returning carts.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Return My Cart, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Return My Cart'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO Return My Cart IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Return My Cart, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any law or third-party right; and (d) for Workers, your physical activities while locating, handling, transporting, or returning carts.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including Sections 7 through 13.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. The exclusive venue for any dispute not subject to binding arbitration is the state or federal courts located in Clark County, Nevada (Las Vegas), and you consent to personal jurisdiction in those courts.
14. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
